Madras High Court Advocates Association challenges 1965 Union Cabinet decision to continue English as common language for Supreme Court and all High Courts
The Madras High Court Advocates Association has challenged a 1965 Cabinet Committee decision retaining English as the common language of the Supreme Court and High Courts until Hindi could replace it. The PIL invokes Articles 14, 19, 21 and 348(2), and disputes treating consultation with the Chief Justice of India as mandatory consent.
The challenged Cabinet Committee decision was approved on May 21, 1965 after an MHA note was placed before it on May 17, 1965.
A March 1965 conference of Chief Justices recommended a common judicial language, with English continuing until Hindi could replace it.
Article 348(2) permits a Governor, with the President’s previous consent, to authorise a regional language in High Court proceedings.
The Article 348(2) permission described in the report does not extend to judgments, decrees or orders passed by the High Court.
Hindi was permitted in Rajasthan High Court in 1950 and in the High Courts of Uttar Pradesh, Madhya Pradesh and Bihar from 1969, 1971 and 1972 respectively.
